Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("you", "merchant", or "user") and SiteSketcher ("SiteSketcher", "we", "us", or "our") and govern your access to and use of our online storefront builder, dashboard, websites, and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility and your account
You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of a business, you represent that you are authorised to bind that business to these Terms.
You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You agree to provide accurate, current information, to keep it up to date, and to notify us promptly of any unauthorised use of your account.
2. The Service
SiteSketcher provides software that lets you design, publish, and operate one or more online stores, manage products and orders, and connect optional features such as payments, custom domains, and marketing integrations. We may add, change, or remove features over time to improve the Service.
3. Plans, billing, and renewals
The Service is offered on free and paid subscription plans. The features and limits of each plan are described at the point of sign-up or upgrade. By choosing a paid plan you agree to the following:
- Fees and billing cycle — paid plans are billed in advance on a recurring basis (for example, monthly or annually) according to the plan you select.
- Automatic renewal — paid subscriptions renew automatically for successive periods unless you cancel before the renewal date. You can change or cancel your plan at any time from your dashboard; changes take effect according to your billing cycle.
- Downgrades and expiry — if a paid subscription expires or is not renewed, your account may be automatically moved to a free plan, and features or capacity exceeding that plan may become unavailable.
- Taxes — fees are exclusive of taxes unless stated otherwise; you are responsible for any applicable taxes.
- Refunds — except where required by applicable law, fees are non-refundable, and there are no refunds or credits for partial periods.
- Payment processing — subscription payments are handled by third-party payment processors (such as PayTabs and Paymob). Your use of those services is subject to their terms, and we are not responsible for their acts or omissions.
4. Acceptable use
You agree not to misuse the Service. In particular, you must not:
- Use the Service for any unlawful, fraudulent, infringing, or deceptive purpose, or sell prohibited or counterfeit goods;
- Upload or distribute content that is illegal, defamatory, obscene, hateful, or that infringes the intellectual-property or privacy rights of others;
- Attempt to disrupt, overload, or gain unauthorised access to the Service, other accounts, or our systems;
- Probe, scan, or reverse-engineer the Service except to the extent permitted by law, or use it to build a competing product;
- Send spam or unsolicited messages, distribute malware, or otherwise harm users or third parties; or
- Resell or sublicense the Service except as we expressly permit.
- We may investigate suspected violations and may suspend or terminate accounts that breach this section.
5. Your content and your store
You retain ownership of the products, text, images, data, and other content you add to your store ("Your Content"). You grant us a worldwide, non-exclusive licence to host, store, reproduce, and display Your Content solely to operate and provide the Service to you and your shoppers.
You are responsible for Your Content and for your store, including its accuracy, legality, and compliance with applicable law. You represent that you have the rights needed to use and share Your Content.
6. Merchant responsibilities
As a merchant, you operate an independent business using the Service, and you are solely responsible for it. This includes, among other things:
- Complying with all laws applicable to your store — including consumer-protection, e-commerce, advertising, tax, and data-protection laws;
- Issuing accurate invoices and, where required, electronic tax receipts (for example, Egyptian Tax Authority e-receipts), and paying any taxes due on your sales;
- Acting as the data controller for your shoppers' personal data, publishing your own privacy notice, and obtaining any required consents (including for any marketing pixels or messages you enable);
- Setting and honouring your own pricing, shipping, returns, and refund policies, and fulfilling orders and customer support; and
- The accuracy and legality of the products and information you sell and publish.
7. Third-party services and custom domains
The Service can connect to third-party services such as payment gateways, custom-domain providers, and marketing platforms. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them. If you connect a custom domain, you are responsible for the domain registration and for the rights to use it.
8. Intellectual property
The Service, including its software, templates, designs, and the SiteSketcher name and logo, is owned by us or our licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription, subject to these Terms. Except for that right, we reserve all rights, and you may not copy, modify, or create derivative works of the Service.
9. Availability and changes
We work hard to keep the Service available, secure, and performant, but we provide it on an "as is" and "as available" basis and do not guarantee uninterrupted or error-free operation. We may perform maintenance, and we may modify, suspend, or discontinue features, with reasonable notice where practicable.
10. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay fees, or use the Service in a way that risks harm to us, other users, or third parties — and, where reasonable, we will give you notice and an opportunity to resolve the issue.
On termination, your right to use the Service ends and your store may be taken offline. We may delete your data after a reasonable period, subject to our retention obligations described in the Privacy Policy. Provisions that by their nature should survive termination — including ownership, disclaimers, limitations of liability, and governing law — will survive.
11. Disclaimers
To the maximum extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements, be uninterrupted, or be free of errors, and we are not responsible for the conduct of merchants or shoppers using the platform.
12. Limitation of liability
To the maximum extent permitted by law, SiteSketcher and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service. To the extent we are found liable, our total aggregate liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
13. Indemnification
You agree to indemnify and hold harmless SiteSketcher and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your store, Your Content, your products, your breach of these Terms, or your violation of any law or the rights of a third party.
14. Governing law and disputes
These Terms are governed by the laws of the Arab Republic of Egypt, without regard to conflict-of-law principles. The courts of Egypt will have jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where mandatory law gives you the right to bring proceedings elsewhere.
15. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will revise the "Last updated" date above and provide notice where appropriate. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
